Terms & Conditions
These Terms and Conditions ("Terms") are a binding agreement between you and Broker Free, operated by Stoyan Hristov, an individual based in Sofia, Bulgaria ("Broker Free", "we", "us", "our"), operator of the Broker Free mobile application and related services (the "Service"). By creating an account or using the Service, you confirm that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. What Broker Free is, and is not
Broker Free is a neutral technology venue that lets property owners list residential and commercial property for sale or rent, and lets interested users discover listings, message owners, and book viewings, directly, without brokers or agents.
Broker Free is not a real-estate agent, broker, agency, dealer, landlord, tenant, property manager, builder, inspector, surveyor, valuer, escrow, insurer, or a party to any transaction, viewing, lease, or sale between users. We do not own, possess, control, inspect, visit, verify, endorse, appraise, insure, or guarantee any property, listing, photo, price, document, or user. We do not provide legal, financial, tax, insurance, structural, or real-estate advice, and nothing in the Service is such advice.
Any communication, agreement, viewing, payment, deposit, lease, sale, or other dealing is solely between the users involved. You are responsible for your own due diligence, inspections, contracts, payments, insurance, and compliance with all applicable laws. You must independently verify the identity of any user, the ownership and condition of any property, and the accuracy of any listing before relying on it, paying any money, or entering into any agreement.
2. Eligibility and accounts
You must be at least 18 and legally able to enter a binding contract. Your account is anchored to your verified mobile phone number; you are responsible for everything done under your account and for keeping access to it secure. One person may hold one account. You must provide accurate information and keep it current. We may refuse, suspend, or terminate accounts at our discretion, including for fraud, impersonation, or breach of these Terms.
3. Acceptable use
You will not: use the Service as a broker, agent, or agency, or list property you do not own or are not authorised to list; post fake, misleading, duplicate, expired, or fraudulent listings, photos, or prices; circumvent the platform by sharing or soliciting contact details to take a deal off Broker Free; harass, threaten, defame, discriminate against, stalk, scam, or abuse anyone, or post unlawful, hateful, or inappropriate content; capture, screenshot, screen-record, scrape, copy, or redistribute other members' photos, listings, or messages beyond your own legitimate use; use bots or automated means, or attempt to interfere with, overload, reverse-engineer, or gain unauthorised access to the Service. You acknowledge that messages are automatically scanned for prohibited content and circumvention attempts (see section 9). Violations may lead to content removal, warnings, temporary suspension, or a permanent ban, and may be reported to the authorities.
4. Listings
You are solely responsible for your listings and represent and warrant that you own or are authorised to list the property and that all information, photos, prices, and documents are accurate, current, and lawful. We may require listings to be reviewed before going live and may reject, hide, edit, expire, or remove any listing at our discretion, without liability. The number of active listings and the features available depend on your subscription tier; hidden listings are limited and may be removed automatically after a period. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display your content to operate and promote the Service; you retain ownership of your content.
5. Bookings, viewings, and reviews
Bookings and viewings are arrangements between users; we are not a party to them and do not guarantee that any viewing will occur, that any party will attend, or that any property, person, or information will be as described. To keep the marketplace fair we track attendance, no-shows, and cancellations, apply cancellation limits near the viewing time, and may record these against your account. After an interaction, users may leave honest ratings and reviews; reviews are the views of the users who write them, not of Broker Free, and we may remove reviews that are fake, abusive, or that breach these Terms.
6. Property condition, viewings, and your personal safety
Broker Free does not inspect, visit, test, survey, or verify any property or any user. We make no representation or warranty of any kind about any property's existence, ownership, boundaries, measurements, condition, safety, habitability, legality, permits, title, fixtures, utilities, or fitness for any purpose, or about the identity, character, solvency, or conduct of any user.
You acknowledge and agree that meeting other people and entering or inspecting property carry inherent risks, and that you accept those risks voluntarily. These risks include, without limitation: personal injury, illness, or death; assault, theft, robbery, or fraud; damage to or loss of property or money; and exposure to unsafe, defective, or unlawful conditions, including fire, smoke, flood, water damage, gas, carbon monoxide, electrical faults, structural defects or collapse, falls, asbestos, mould, pests, hazardous materials, and animals.
You attend viewings, communicate, and deal with other users entirely at your own risk and are solely responsible for your own safety, health, and belongings. We strongly recommend that you verify the other person's identity independently, meet during daylight where possible, bring someone with you, tell someone where you are going, and never transfer money, deposits, or documents before you have satisfied yourself, through your own checks, that the property and the other party are genuine. Broker Free is not responsible for, and you release us from, any harm, loss, injury, death, or damage arising from any viewing, meeting, property, or dealing between users.
7. Subscriptions, payments, and consumables
Broker Free offers free and paid tiers and one-time paid features (such as "Featured" or "Boost"). All payments are processed by Apple (App Store) or Google (Google Play), not by Broker Free; we never receive or store your card details. Paid subscriptions auto-renew unless cancelled at least 24 hours before the period ends; you manage and cancel them through your Apple or Google account settings. Payments are generally non-refundable except where required by law or by Apple/Google policy; one-time features are consumed when applied and are non-refundable once used. Prices and plans may change, applying from your next renewal. Paid tiers and boosts only affect listing limits, visibility, and platform features; they are not brokerage, advisory, or guarantee services, and buying them does not make any listing or user verified, endorsed, or safe.
8. Connections
Contacting an owner or booking a viewing may consume a "connection" from your allowance. Connections are a platform feature, not currency; they have no cash value, are non-transferable, and are non-refundable except as expressly provided in-app (for example, an automatic refund when a booking is rejected or cancelled by the other party).
9. Moderation, enforcement, and content review
To protect users and enforce these Terms, we may review, moderate, remove, or restrict content, listings, reviews, and accounts, automatically and manually, but we are under no obligation to monitor and do not guarantee that we will detect or prevent any prohibited content or conduct. Messages may be automatically scanned to detect prohibited content and platform-circumvention attempts; flagged content and metadata may be logged and reviewed by our moderators for safety and enforcement. When a user reports another user or listing, we may capture a minimised snapshot of relevant content (a chat excerpt, the listing, booking context) for that safety review. Capturing other members' content may be detected and logged; repeated capture may lead to automatic temporary suspension and, on continued abuse, a permanent ban. Depending on severity and history we may warn, hide or remove content, temporarily suspend, or permanently ban an account, with or without prior notice. You may appeal via in-app support.
10. Data protection (GDPR)
We process personal data per our Privacy Policy and applicable law, including the EU GDPR. We minimise data: phone numbers are stored only as a one-way hash, evidence snapshots are minimised and moderator-only, and moderation records are kept only as long as necessary. You may exercise your rights (access, rectification, erasure, portability, objection) as described in the Privacy Policy. Deleting your account removes or anonymises your personal data, subject to records we must retain for legal or safety reasons.
11. Identity changes and recovery
To prevent abuse and account takeover, changing your attached sign-in (Apple or Google) and changing your phone number are rate-limited (each generally allowed once per defined period). Your phone number remains your account anchor across devices and platforms. If you lose access to your number, you may attempt recovery in-app or via support; we may require verification and may decline where ownership cannot be confirmed.
12. Intellectual property
The Service, including its software, design, the "Broker Free" name and logo, and related materials, is owned by Broker Free and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. All rights not expressly granted are reserved.
13. Disclaimers and no warranty
To the maximum extent permitted by law, the Service and all content are provided "as is" and "as available", without warranties or conditions of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, quiet enjoyment, or non-infringement.
We do not warrant or guarantee that: any listing, property, photo, price, document, or user is genuine, accurate, complete, lawful, available, or safe; any property exists, is owned by the person listing it, or is as described; any viewing, transaction, payment, lease, or sale will take place, complete, or be honoured; the Service will be uninterrupted, secure, timely, or error-free, or that defects will be corrected; or that the Service is free of viruses or harmful components. Any reliance you place on listings, users, or content is at your own risk.
14. Assumption of risk and release between users
You understand that Broker Free is only a venue and is not involved in, and has no control over, the dealings between users or the condition, safety, or legality of any property. To the maximum extent permitted by law, you release and forever discharge Broker Free, and our operators, suppliers, and partners, from any and all claims, demands, disputes, damages, losses, liabilities, costs, and expenses of every kind, whether direct or indirect, known or unknown, arising out of or in any way connected with:
(a) the existence, ownership, condition, safety, legality, or use of any property; (b) any act, omission, conduct, misrepresentation, fraud, negligence, or default of any user or other third party; (c) any viewing, meeting, communication, negotiation, transaction, lease, sale, deposit, or dispute between users; (d) personal injury, illness, death, assault, theft, or loss of or damage to property or money occurring before, during, or after any viewing, meeting, or transaction; (e) fire, flood, gas, electrical, structural, environmental, or other hazards at any property; and (f) any content posted, sent, or relied upon through the Service.
If you have a dispute with one or more users, you pursue it directly with them and not with Broker Free.
15. Limitation of liability
To the maximum extent permitted by law, Broker Free will not be liable for any indirect, incidental, special, punitive, or consequential damages, or for any loss of profits, revenue, goodwill, data, deposits, money, opportunity, or property, arising from or related to your use of (or inability to use) the Service, any transaction, viewing, or dispute with another user, any user's conduct, any property, or any content, even if we have been advised of the possibility of such damages, and whether the claim is based in contract, tort (including negligence), statute, or otherwise.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or related to the Service is limited to the greater of (a) the total amount you actually paid us in the three (3) months before the event giving rise to the claim, or (b) EUR 50.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our own negligence, for our own fraud or fraudulent misrepresentation, or for your mandatory, non-waivable statutory rights as a consumer. Where liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.
16. Indemnification
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Broker Free, and our operators, suppliers, and partners, from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from or related to your content, your use of the Service, your dealings with other users, any property you list or visit, or your breach of these Terms or of any law or third-party right.
17. Third-party services
The Service relies on third parties, including Apple and Google (app distribution and payments), Google Firebase (authentication and notifications), Supabase (backend hosting), Cloudflare (image storage and delivery), and Google AdMob (advertising). Their services are governed by their own terms and policies, and we are not responsible for their acts, omissions, availability, or content. The Service may also contain links or content provided by users or third parties, which we do not control or endorse.
18. Force majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disasters, fire, flood, epidemic, war, civil unrest, strikes, failures of power, internet, hosting, or third-party services, or governmental action.
19. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access at our discretion, including for breach, suspected fraud or harm, legal requirement, or discontinuation of the Service, with or without notice. Provisions that by their nature should survive termination (including sections 1, 6, 12 to 18, and 20) survive.
20. Governing law and disputes
These Terms are governed by the laws of the Republic of Bulgaria and applicable EU law. The courts of Sofia, Bulgaria have jurisdiction, except that, if you are a consumer, you retain the protection of the mandatory laws and competent courts of your country of residence in the EU, and may use the EU Online Dispute Resolution platform.
21. Changes
We may update these Terms. Material changes will be notified in-app and/or by a new version, which may require you to accept again. Continued use after changes take effect constitutes acceptance.
